प्रश्न 14. संसदात्मक शासन
से आप क्या समझते हैं ? इसके गुण-दोष बताइए।
अथवा संसदात्मक
शासन क्या है ? यह अध्यक्षात्मक
शासन से किस प्रकार भिन्न है ?
उत्तर - यदि कार्यपालिका और
विधायिका में परस्पर घनिष्ठ सम्बन्ध है तथा वे दोनों मिलकर शासन करते हैं और
कार्यपालिका विधायिका के प्रति उत्तरदायी होती है, तो उसे संसदीय शासन कहते हैं । संसदीय शासन को 'उत्तरदायी शासन' तथा 'मन्त्रिमण्डल
सरकार' के नाम से भी
जाना जाता है । इसे 'उत्तरदायी शासन' इसलिए कहते हैं
क्योंकि मन्त्रिमण्डल संसद के प्रति उत्तरदायी होता है। इसे 'मन्त्रिमण्डल
सरकार' इसलिए कहते हैं
क्योंकि इसमें शासन की कार्यपालिका की वास्तविक सत्ता मन्त्रिमण्डल के द्वारा
उपयोग की जाती है।
भारत, इंग्लैण्ड , जापान , कनाडा आदि देशों
में संसदात्मक शासन प्रणाली प्रचलित
गार्नर के मतानुसार, “संसदीय
शासन वह शासन प्रणाली है जिसमें वास्तविक कार्यपालिका अर्थात् मन्त्रिमण्डल
व्यवस्थापिका अथवा उसके लोकप्रिय सदन के प्रति तथा अन्तिम रूप में निर्वाचक मण्डल
के प्रति अपनी राजनीतिक नीतियों तथा कार्यों के लिए कानूनी रूप से उत्तरदायी होती
है और राज्य का प्रधान नाममात्र का तथा अनुत्तरदायी होता है।"
संसदात्मक शासन के गुण
संसदात्मक शासन में
निम्नलिखित गुण पाए जाते हैं
(1) व्यवस्थापिका और कार्यपालिका में सहयोग और सामंजस्य–
· संसदात्मक शासन व्यवस्था में व्यवस्थापिका के
द्वारा कानून-निर्माण के कार्य में पर्याप्त ज्ञान और अनुभव रखने वाले
कार्यपालिका के सदस्यों से सहायता प्राप्त की जाती है। इस प्रकार संसदात्मक शासन
में व्यवस्थापिका और कार्यपालिका के पारस्परिक सहयोग के आधार पर श्रेष्ठ कानूनों
का निर्माण और जन-कल्याणकारी प्रशासन सम्भव हो
(2) शासन व्यवस्था जनता के प्रति उत्तरदायी -
· संसदात्मक शासन में मन्त्री संसद के प्रति
उत्तरदायी होते हैं तथा संसद के माध्यम से जनता के प्रति उत्तरदायी होते हैं। मन्त्रीयों को अपने पद पर बने रहने के लिए जनता के दृष्टिकोण का ध्यान रखकर उसके
अनुसार कार्य करना पड़ता है। इस प्रकार इस शासन व्यवस्था में लोकमत का उचित आदर
होता है और लोकहित की साधना सम्भव हो पाती है।
(3) सरकार निरंकुश नहीं हो पाती-
·
संसदीय शासन में सरकार व्यवस्थापिका के प्रति
उत्तरदायी होती है, इसलिए वह कभी
निरंकुश नहीं हो पाती । व्यवस्थापिका में विद्यमान विरोधी दल शासन पर अंकुश बनाए
रखने का कार्य करता है।
(4) गत्यावरोध की कम आशंका-
·
संसदीय शासन में व्यवस्थापिका और कार्यपालिका
बहुत अधिक श्रेष्ठ रूप में सहयोग करती हैं, जिससे गत्यावरोध उत्पन्न होने की कोई आशंका नहीं होती।
(5) अवसरानुकूल परिवर्तनशीलता-
·
संसदात्मक शासन में इस बात की गुंजाइश रहती है
कि राष्ट्रीय संकट के किसी साधारण अवसर पर राजशक्ति का प्रयोग करने वाले
व्यक्तियों में परिवर्तन किया जा सके । इस शासन व्यवस्था में विपत्ति के अवसर पर
व्यवस्थापिका देश के सर्वमान्य नेता को असाधारण शक्ति प्रदान कर सकती है और सभी राजनीतिक
दलों का सहयोग प्राप्त करने के लिए मिले-जुले मन्त्रिमण्डल का निर्माण किया जा
सकता है।
(6) योग्यतम, अनुभवी एवं लोकप्रिय व्यक्तियों का शासन -
·
व्यवस्थापिका के जिन सदस्यों को अपने अनुभव एवं
योग्यता के आधार पर अपने राजनीतिक दल और देश की राजनीति में बहुत अधिक लोकप्रियता और सम्मान
प्राप्त हो जाता है, वे व्यक्ति
साधारणतया मन्त्रिमण्डल के सदस्य नियुक्त किए जाते हैं। इनके द्वारा शासन का
संचालन जनहित के लिए ही किया जाता है।
(7) राजनीतिक शिक्षा–
·
संसदात्मक शासन में जनता को राजनीतिक शिक्षा
प्राप्त करने का अधिक अवसर प्राप्त होता है। जनता व्यवस्थापिका के कार्यों का
विवरण रुचिपूर्वक पढ़ती है और सार्वजनिक समस्याओं के सम्बन्ध में ज्ञान कराती है।
●संसदात्मक शासन के दोष
संसदात्मक शासन के प्रमुख दोष निम्नलिखित हैं
(1) शक्ति विभाजन सिद्धान्त का विरोध-
शक्ति पृथक्करण
का सिद्धान्त लोकतन्त्र का अमूल्य सिद्धान्त है, किन्तु संसदात्मक शासन में कार्यपालिका और व्यवस्थापिका में
घनिष्ठ सम्बन्ध होता है।
(2) दलीय तानाशाही का भय-
संसदात्मक शासन
में व्यवस्थापिका के निम्न सदन में जिस राजनीतिक दल को बहुमत प्राप्त होता है,
उसके द्वारा कार्यपालिका का निर्माण किया जाता
है । इस प्रकार कार्यपालिका और व्यवस्थापिका की शक्तियाँ एक | राजनीतिक दल में निहित होने के कारण उसकी
स्थिति तानाशाह जैसी हो सकती है।
(3) निर्बल शासन-
संसदात्मक शासन में कोई एक ऐसा व्यक्ति नहीं होता जिसके हाथ में शासन की
सम्पूर्ण शक्ति हो और राज्य के प्रशासन के लिए वह पूर्ण रूप से उत्तरदायी हो।
(4) बहुदलीय व्यवस्था में सरकार बनाने में कठिनाई -
व्यवस्थापिका में
किसी दल को स्पष्ट बहुमत न मिलने पर सरकार बनाने में कठिनाई उत्पन्न हो सकती है।
(5) कार्यकाल की अस्थिरता -
कार्यकाल की
अस्थिरता के कारण मन्त्रिगण ऐसी योजनाएँ प्रस्तावित करने के लिए उत्सुक नहीं होते
जिन्हें कार्यान्वित करने के लिए काफी समय की आवश्यकता होती है।
(6) अक्षम व्यक्तियों का शासन -
प्रधानमन्त्री
द्वारा मन्त्रिमण्डल का निर्माण योग्यता के आधार पर नहीं, बल्कि दलीय आधार पर किया जाता है।
(7) मन्त्रिमण्डल की निरंकुशता का भय-
·
संसदात्मक शासन
में मन्त्रिमण्डल के सदस्य अनिवार्य रूप से संसद के किसी भी सदन के सदस्य होते हैं
और मन्त्रिमण्डल का अध्यक्ष (प्रधानमन्त्री) संसद के निम्न सदन के बहुमत दल का
नेता होता है। अत: विधायिका पर कार्यपालिका का पूर्ण रूप से नियन्त्रण होता है।
(8) उग्र राजनीतिक दलबन्दी-
·
संसदात्मक शासन
में शासन शक्ति प्राप्त करने की आशा में राजनीतिक दल सदैव ही अत्यधिक सक्रिय रहते
हैं । सत्तारूढ़ दल और विरोधी दलों में सत्ता हथियाने के लिए आरोप-प्रत्यारोप चलते
रहते हैं, जिससे देश का राजनीतिक
वातावरण दूषित हो जाता है।
(9) संकटकाल में कार्यपालिका की निर्बलता-
·
संसदात्मक शासन
युद्ध अथवा संकटकाल की स्थिति में बहुत निर्बल होता है।
(10) जनमत को प्रसन्न करने की भावना-
·
संसदात्मक शासन
की आलोचना में एक तर्क यह प्रस्तुत किया जाता है कि सरकार जनमत की इच्छाओं की
पूर्ति करना अपना परम कर्तव्य
समझती है । वह विधानमण्डल में ऐसे प्रस्तावों और विधेयकों को परतुत करती है जिनको
मतदाता चाहते हैं, चाहे उनसे राज्य
का हित हो अथवा नहीं।
● संसदात्मक और अध्यक्षात्मक शासन में अन्तर
संसदात्मक और अध्यक्षात्मक शासन में प्रमुख
अन्तर निम्नलिखित हैं
(1) संसदात्मक शासन में कार्यपालिका का प्रधान नाममात्र का प्रधान होता है । मान्तिक दृष्टि से वह पूर्ण शक्ति सम्पन्न होता है, लेकिन व्यवहार में उसकी इन शक्तियों का प्रयोग मन्त्रिपरिषद् के द्वारा ही किया जाता है। इसके विपरीत अध्यक्षात्मक शासन में कार्यपालिका का प्रधान न केवल औपचारिक वरन् वास्तविक अपान भी होता है । वही मन्त्रिपरिषद् के सदस्यों की नियुक्ति करता है और ये सदस्य पूर्णतया उसके अधीन होते हैं।
(2) संसदात्मक शासन में कार्यपालिका का निर्माण व्यवस्थापिका में से ही किया जाता है और यह व्यवस्थापिका के प्रति ही उत्तरदायी होती है। कार्यपालिका के सदस्य विधानमण्डल में उपस्थित होते हैं और विधि-निर्माण सम्बन्धी कार्यों में भाग लेते हैं। इसके विपरीत अध्यक्षात्मक शासन शक्ति पृथक्करण के सिद्धान्त पर आधारित होता है । इसके अन्तर्गत कार्यपालिका का निर्माण व्यवस्थापिका से स्वतन्त्र रूप में किया जाता है । कार्यपालिका के सदस्य विधि-निर्माण सम्बन्धी कार्यों में भाग नही ले सकते।
(3) संसदात्मक शासन में कार्यपालिका का कार्यकाल निश्चित नहीं होता और वस्थापिका अविश्वास प्रस्ताव पारित कर कभी भी कार्यपालिका को पदच्युत कर सकती है। इसके विपरीत अध्यक्षात्मक शासन में कार्यपालिका का कार्यकाल निश्चित होता है और महाभियोग के अतिरिक्त अन्य किसी प्रकार से कार्यपालिका को पदच्युत नहीं किया जा सकता।

Question 14. What do you understand by parliamentary
governance? Explain its merits.
Or what is
parliamentary governance? How is it different from presidential rule?
Answer - If there is a close relationship between the
executive and the legislature and they both govern together and the executive
is responsible to the legislature, it is called parliamentary rule.
Parliamentary rule is also known as 'responsible governance' and 'cabinet
government'. This is called 'responsible governance' because the Cabinet is
responsible to the Parliament. This is called 'Cabinet Government' because in
this the actual power of executive of the government is exercised by the
Cabinet.
In countries like India, England, Japan, Canada etc., the
system of parliamentary governance prevalent
According to Garner, "Parliamentary governance is the governance system in which the actual
executive is legally responsible for his political policies and actions, ie to
the administrative administrator or to his popular house and ultimately to the
electoral college and the head of state is nominally And is unresponsive.
"
● Properties of parliamentary governance
The
following qualities are found in parliamentary governance-
(1) Cooperation and co-ordination in the executive and executive -
• In administrative governance, assistance is received by
the members of the executive having sufficient knowledge and experience in
law-making. In this way, the creation of best laws and public welfare
administration possible on the basis of mutual cooperation of the
administrative and executive in parliamentary governance.
(2) Governance responsible for the people -
• In parliamentary governance, ministers are responsible to
Parliament and are responsible to the public through Parliament. The lanes have
to work according to the public's viewpoint to stay in office. In this way,
public opinion is respected in this system of governance and cultivation of
public interest is possible.
(3) Government is not autocratic
• In parliamentary government, the government is responsible
to the administrator, so it is never autocratic. The existing opposition party
in the administration works to control the rule.
(4) Less fear of obstruction-
• In parliamentary governance, the administrator and the
executive cooperate very well, so that there is no possibility of obstruction.
(5) favorable variability-
• In parliamentary governance, there is scope to change the
people who use the power of the state on a simple occasion of national crisis.
On the occasion of calamity in this governance system, the administrator can
give extraordinary power to the common leader of the country and a mixed
cabinet can be built to get the support of all political parties.
(6) Governance of the most qualified, experienced and popular persons
• Members of the administration who have gained a lot of
popularity and respect in their political party and the politics of the country
on the basis of their experience and qualifications, are usually appointed as
members of the Cabinet. Through them, governance is conducted for the public
interest only.
(7) Political education -
• Public gets more opportunity to get political education in
parliamentary governance. The public reads the details of the functions of the administrator
and provides knowledge in relation to public problems.
● Faults of parliamentary governance
Following
are the major drawbacks of parliamentary governance
(1) Opposition to the power division principle-
The principle of separation of power is an invaluable
principle of democracy, but there is a close relationship between executive and
administrative in parliamentary governance.
(2) Fear of party dictatorship
In parliamentary governance, the executive is formed by the
political party that gets the majority in the lower house of the administrator.
In this way the powers of executive and administrator are one. Being rooted in
a political party, it can have a dictator status.
(3) Weak governance-
In parliamentary governance there is no one who has full
power of governance in his hands and is fully responsible for the
administration of the state.
(4) Difficulty in forming government in multi-party
system -
The difficulty in forming
a government may arise if a party does not get a clear majority in the administration.
(5) Instability of tenure -
Due to instability of
tenure, the ministries are not keen to propose schemes that require a lot of
time to implement.
(6) Governance of disabled persons -
The Cabinet is built by
the Prime Minister not on merit, but on party basis.
(7) Fear of autocracy of the Cabinet
• Members of the Cabinet
are essentially members of either House of Parliament in parliamentary
governance and the President (Prime Minister) of the Cabinet is the leader of
the majority party of the lower house of Parliament. Therefore, the executive
is fully controlled by the legislature.
(8) Upright political interference
• Political parties are
always highly active in the hope of gaining power under parliamentary rule.
Accusations and counter-attacks take place in the ruling party and the opposing
parties, which corrupts the political environment of the country.
(9) Weakness of executive in crisis-
• Responsive governance
is very weak in the event of war or crisis.
(10) A feeling of pleasing public opinion.
• An argument is
presented in the criticism of parliamentary rule that the government considers
it its absolute duty to fulfill the wishes of public opinion. It lays down such
proposals and Bills in the Legislature which the voters want, whether they are
in the interest of the state or not.
● Difference between parliamentary and presidential rule
Following are the major differences between
parliamentary and presidential rule
(1) In parliamentary governance, the head of the executive is the nominal head.
From the mental point of view, he is full of power, but in practice these
powers are exercised only by the Council of Ministers. In contrast, in
executive rule, the head of the executive is not only formal but also real
inane. He appoints members of the Council of Ministers and these members are
completely under him.
(2) In parliamentary governance, the executive is created from within the
administrator and is responsible only to the administrator. Members of the executive
appear in the legislature and participate in law-making functions. In contrast,
presidential rule is based on the principle of power separation. Under this,
the executive is created independently of the administrator. Executive members
cannot participate in law-related work.
(3) The term of executive is not fixed in parliamentary
governance and the establishment can remove the executive anytime by
passing a no confidence motion. In contrast, the tenure of the executive is
fixed in the presidential rule and the executive cannot be removed in any way
other than impeachment.
