प्रश्न 15. अध्यक्षात्मक शासन से आप क्या समझते हैं ? इसके गुण तथा दोष बताइए।

उत्तर - अध्यक्षात्मक शासन प्रणाली शक्ति पृथक्करण के सिद्धान्त पर आधारित है। इस शासन व्यवस्था में व्यवस्थापिका, कार्यपालिका और न्यायपालिका सभी एक दूसरे से पृथक व स्वतन्त्र रहकर अपने-अपने क्षेत्रों में कार्य करते हैं । अध्यक्षीय शासन में कार्यपालिका शक्तियाँ राष्ट्रपति में निहित होती हैं, जिनका प्रयोग वह विधान के अन्तर्गत स्वतन्त्रतापूर्वक करता है । 

दूसरे शब्दों में,राष्ट्रपति व उसके मन्त्री न विधानमण्डल के सदस्य होते हैं और न उसके प्रति उत्तरदायी होते हैं । विधानमण्डल अविश्वास प्रस्ताव के द्वारा उसे उसकी निर्धारित अवधि से पहले नहीं हटा सकता। इसी प्रकार कार्यपालिका भी विधानमण्डल या उसके किसी सदन को भंग नहीं कर सकती।

डॉ. गार्नर के अनुसार, अध्यक्षात्मक सरकार वह होती है जिसमें कार्यपालिका अर्थात् राज्य का अध्यक्ष तथा उसके मन्त्री अपनी अवधि के बारे में संविधान की दृष्टि से विधानमण्डल से स्वतन्त्र होते हैं और अपनी राजनीतिक नीतियों के सम्बन्ध में भी उसके प्रति अनुत्तरदायी होते हैं। __

गैटेल के शब्दों में,अध्यक्षात्मक शासन वह प्रणाली है जिसमें कार्यपालिका का प्रधान अपने कार्यकाल तथा बहुत कुछ सीमा तक अपनी नीतियों एवं कार्यों के लिए व्यवस्थापिका से स्वतन्त्र होता है।" - 

अमेरिका, ब्राजील तथा लैटिन अमेरिकी देशों में अध्यक्षात्मक शासन प्रणाली ही प्रचलित है।

अध्यक्षात्मक शासन की विशेषताएँ

अध्यक्षात्मक शासन की प्रमुख विशेषताएँ निम्न प्रकार हैं

(1) अध्यक्षात्मक शासन में केवल एक ही कार्यपालिका (राष्ट्रपति) होती है।

(2) कार्यपालिका का कार्यकाल निश्चित होता है अर्थात् वह विधानमण्डल के ' प्रति उत्तरदायी नहीं होती।

(3) अध्यक्षात्मक शासन में शक्ति पृथक्करण होता है अर्थात् विधानमण्डल व कार्यपालिका एक-दूसरे को भंग नहीं कर सकते । राष्ट्रपति व मन्त्री विधानमण्डल के सदस्य भी नहीं होते हैं।

(4) अध्यक्षात्मक शासन में राष्ट्रपति शासन का वास्तविक स्वामी होता है।

अध्यक्षात्मक शासन प्रणाली के गुण

अध्यक्षात्मक शासन प्रणाली के प्रमुख गण निम्न प्रकार हैं

(1) शासन में स्थायित्व - 

अध्यक्षात्मक शासन प्रणाली में कार्यपालिका का प्रधान एक निश्चित अवधि के लिए चुना जाता है । कार्यपालिका को व्यवस्थापिका द्वारा अविश्वास प्रस्ताव पारित करके नहीं हटाया जा सकता। उसे हटाने के लिए महाभियोग की नीति ही अपनानी होती है। परिणाम यह होता है कि सरकार का स्थायित्व बना रहता है और कार्यपालिका का अध्यक्ष अपनी नीतियों के अनुसार शासन कार्य को सुचारु रूप से चलाता रहता है।

(2) शासन में दक्षता - 

अध्यक्षात्मक शासन प्रणाली में शासन में दक्षता के दर्शन होते हैं। कार्यपालिका के व्यवस्थापिका से स्वतन्त्र रहने के कारण कार्यपालिका के साहस, दृढ़ता निर्णय कुशलता और दक्षता में वृद्धि होती है । चूँकि कार्यपालिका का शासन का संचालन करना है, अतः वह शासन कार्य को कुशलतापूर्वक चलाती है।

(3) संकटकाल के लिए अत्युत्तम - 

इस प्रणाली में सरकार की वासाविक राष्ट्राध्यक्ष के पास होती हैं। वह व्यवस्थापिका अथवा मन्त्रिमण्डल के से परामर्श लेने के लिए बाध्य नहीं है। अतएव जब कभी संकटकालीन ति उत्पन्न होती है, तो वह पूरी दृढ़ता से संकट का मुकाबला करने में समर्थ होता है

(4) राष्ट्रीय एकता की सुदृढ़ता - 

अध्यक्षात्मक शासन प्रणाली में राष्ट्रीय एकता । अत्यन्त दृढ़ रूप में विद्यमान रहती है। राष्ट्रपति सम्पूर्ण देश का नेता होता है, किसी । दल का नहीं। उसके कार्यों पर दलगत राजनीति का प्रभाव नहीं पड़ता। अतएव ।"शासन व्यवस्था सुचारु रूप से चलती रहती है और राष्ट्रीय एकता में वृद्धि होती है।

(5) नीति की निश्चितता -

इस प्रणाली में कार्यपालिका की वास्तविक शकियाँ एक ही व्यक्ति के हाथ में होती हैं और वह अपनी इच्छानुसार अपना परामर्शदाता चुनता है । वह इस बात के लिए स्वतन्त्र होता है कि वह परामर्शदाता के परागर्श को 'स्वीकार करे या न करे । परिणाम यह होता है कि वहाँ मतों में विभिन्नता के दर्शन नहीं होते।

(6) राज्य शक्ति के पृथक्करण के सिद्धान्त का पालन -

यह पद्धति लोकतन्त्र के उस सिद्धान्त के अधिक अनुकूल है जिसमें राज्य शक्ति के पृथक्करण के सिद्धान्त पर बल दिया जाता है । इस पद्धति में व्यवस्थापिका और न्यायपालिका के कार्य संविधान द्वारा निश्चित रहते हैं और व्यवस्थापिका, कार्यपालिका तथा न्यायपालिका की अपनी अलग-अलग शक्तियाँ होती हैं।

(7) दलबन्दी की बुराइयाँ कम -

अध्यक्षात्मक शासन प्रणाली में दलबन्दी का वैसा उग्र और दूषित वातावरण नहीं रहता जैसा संसदात्मक शासन में देखा जाता है । इस प्रणाली में कार्यपालिका प्रधान (राष्ट्रपति) के निर्वाचन के समय ही राजनीतिक दल सक्रिय रहते हैं। चूँकि कार्यपालिका प्रधान का कार्यकाल निश्चित होता है और उसे बाच में नहीं हटाया जा सकता, अतः राजनीतिक दलों द्वारा उसका अनावश्यक विरोध नहा किया जाता । इस प्रकार अध्यक्षात्मक शासन व्यवस्था में संसदात्मक शासन की तुलना में दलबन्दी की बराडयाँ कम हो जाती हैं।

(8) बहुदलीय प्रणाली के लिए उपयुक्त - 

जिन देशों में बहुदलीय प्रणाली हो, सदाय शासन में सरकार बहत जल्दी-जल्दी बदलती रहती है, जिससे लोकतन्त्र पूर्वक कार्य नहीं कर पाता। बहदलीय प्रणाली में अध्यक्षात्मक शासन कुशलतापूर्वक कार्य कर सकता है,क्योंकि कार्यपालिका प्रधान (राष्ट्रपति) का चुनाव एक निश्चित अवधि के लिए किया जाता है।

अध्यक्षात्मक शासन प्रणाली के दोष

अध्यक्षात्मक शासन प्रणाली के प्रमुख दोष निम्न प्रकार हैं

(1) निरंकुशता की आशंका - 

अध्यक्षात्मक शासन प्रणाली का सबसे प्रमुख दोष यह है कि इसमें राष्ट्रपति का कार्यकाल निश्चित होता है। एक बार निर्वाचित हो जाने के पश्चात् राष्ट्रपति न तो जनता के और न ही जनता द्वारा निर्वाचित प्रतिनिधियों के नियन्त्रण में रहता है । इस प्रकार उसके निरंकुश होने का खतरा बना रहता है।

(2) व्यवस्थापिका और कार्यपालिका में सहयोग का अभाव

अध्यक्षात्मक शासन प्रणाली में शक्ति पृथक्करण सिद्धान्त के पालन के कारण व्यवस्थापिका और कार्यपालिका में सामंजस्य का अभाव पाया जाता है। शासन के इन दोनों अंगों में मतभेद के कारण शासन संचालन में गतिरोध उत्पन्न हो जाता है।

(3) उत्तरदायित्व के निर्धारण की समस्या - 

अध्यक्षात्मक शासन प्रणाली में जब कोई कार्य गलत हो जाता है, तो व्यवस्थापिका इसके लिए कार्यपालिका को और कार्यपालिका व्यवस्थापिका को उत्तरदायी ठहराती है । इस प्रकार दोनों ही एक-दूसरे पर उत्तरदायित्व थोपने का प्रयास करते हैं।

(4) कठोर शासन प्रणाली -

अध्यक्षात्मक शासन प्रणाली में लचीलेपन का गुण नहीं पाया जाता है,जो कि संसदीय शासन में है। इसके तीन कारण हैं-प्रथम,शासन सम्बन्धी सभी बातें संविधान में निश्चित हैं। दूसरे, जब कोई संवैधानिक विवाद उत्पन्न होता है,तो न्यायालय की शरण ली जाती है, जिसका रवैया कठोर ही रहता है। तीसरे,संविधान कठोर होता है, अतः इसमें आवश्यकतानुसार संशोधन नहीं किए जा सकते।

(5) परिवर्तनशीलता का अभाव - 

अध्यक्षात्मक शासन प्रणाली में व्यवस्थापिका और कार्यपालिका के प्रधान का चुनाव एक निश्चित अवधि के लिए किया जाता है और इस निश्चित अवधि से पूर्व उन्हें पद से नहीं हटाया जा सकता। यदि इस अवधि के दौरान कुछ ऐसी परिस्थितियाँ उत्पन्न हो जाएँ जिनके कारण शासन में परिवर्तन करना आवश्यक हो,तो ऐसा करना सम्भव नहीं हो पाता है।

Question 15. What do you understand by presidential rule? Explain its merits and demerits.
Answer - The presidency is based on the principle of power separation. In this governance system, the administrator, executive and judiciary all work separately and independently in their respective areas. Executive powers are vested in the President under President's rule, which he uses freely under the legislation. In other words, the President and his ministers are neither members of the Legislature nor responsible to it. The Legislature cannot remove it before its stipulated period by motion of no confidence. Similarly, the executive cannot dissolve the legislature or any of its houses.

According to Dr. Garner, "A presidential government is one in which the executive, ie the president of the state and his ministers are independent from the legislature in terms of their constitution and are also unresponsive to their political policies." __

In Gatell's words, "Presidential governance is the system in which the executive head is independent of the administration for its tenure and to a large extent its policies and actions." - Presidential governance is prevalent in the United States, Brazil and Latin American countries .

● Features of presidential rule

The salient features of presidential rule are as follows
(1) In presidential rule there is only one executive (President).
(2) The tenure of the executive is fixed, ie, she is not responsible to the legislature.
(3) There is a separation of power in the presidential rule, that is, the legislature and the executive cannot dissolve each other. The President and the Minister are also not members of the Legislature.
(4) In presidential rule, the President is the de facto owner of the rule.

● Qualities of presidential governance

 The major features of the presidential system are as follows

(1) Stability in governance - In presidential system of governance, the head of the executive is elected for a fixed term. The executive cannot be removed by passing a motion of no confidence by the administrator. To remove it, the policy of impeachment has to be adopted. The result is that the stability of the government remains and the president of the executive continues to run the government smoothly according to his policies.

(2) Efficiency in governance - In the system of presidential governance, there are philosophies of efficiency in governance. Being independent from the executive of the executive increases the courage, perseverance, decision efficiency and efficiency of the executive. Since the executive has to administer governance, she runs the administration efficiently.

(3) Excellent for a crisis - In this system, the government's head of state is with the head of state. He is not obliged to consult the administrator or the Cabinet. Therefore, whenever a crisis situation arises, it is able to fight the crisis with firmness.

(4) Strengthening National Integration - National Integration in Presidential Governance System. Mum exists in very firm form. The President is the leader of the entire country, someone. (6) Adherence to the principle of separation of state power - This method is more compatible with the principle of democracy in which the principle of separation of state power is emphasized. In this system, the functions of the administrator and the judiciary are fixed by the constitution and the administrator, executive and judiciary have different powers.

(7) The evils of pandemonium In the less - presidential government system, the pandemonium does not have the same fierce and corrupt environment as seen in parliamentary governance. In this system, political parties remain active only during the election of the executive head (President). Since the tenure of the executive head is fixed and cannot be removed from the Bach, it would have been unnecessarily opposed by political parties. In this way, in the presidential system, there are fewer incidents of punctuality than parliamentary governance.

(8) Suitable for multi-party system - In countries which have multi-party system, the government keeps changing very frequently under the rule of governance, which is not able to function democratically. In multi-party systems, presidential rule can work efficiently, because the executive head (president) is elected for a fixed term.

Defects of presidential governance

The major drawbacks of the presidency are as follows

(1) Fear of autocracy - The main drawback of the presidency is that the president's term is fixed in it. Once elected, the President remains under the control of neither the public nor the representatives elected by the people. Thus there is a danger of him becoming autocratic.

(2) Administrator and Lack of co-operation in executive - Due to adherence to power separation principle in presidential system, lack of cohesion is found in administrative and executive. Due to differences in these two organs of governance, there is a deadlock in governance.

(3) Problem of determination of responsibility - In the system of presidential governance, when an action goes wrong, the administrator holds the executive and the executive administrator responsible for it. Thus both try to impose responsibility on each other.

(4) Rigorous system of governance - The quality of flexibility is not found in the administrative system, which is under parliamentary rule. There are three reasons for this - First, all the things related to governance are fixed in the constitution. Secondly, when a constitutional dispute arises, the court takes refuge, whose attitude is harsh. Thirdly, the constitution is rigid, so it cannot be amended as necessary.

(5) Lack of variability - In presidential system of governors, the head of the administrative and executive is elected for a fixed term and cannot be removed from office before this fixed period. If some circumstances arise during this period due to which changes in governance are necessary, then it is not possible to do so.
